Tshwane: The Madlanga Commission has commenced its proceedings at the Brigitte Mabandla Justice College in Tshwane, with Chairperson Justice Mbuyiseli Madlanga outlining the framework for the commission’s inquiry.
According to South African Government News Agency, the commission’s establishment follows alarming allegations made by KwaZulu-Natal Police Commissioner Lieutenant General Nhlanhla Mkhwanazi regarding a purported criminal syndicate that has allegedly infiltrated law enforcement, the National Prosecuting Authority (NPA), and intelligence services. In his opening address, Justice Madlanga emphasized the importance of a robust criminal justice system to uphold the rule of law and maintain a functioning constitutional democracy. He expressed concern that if these allegations are substantiated, it could spell disaster for the integrity of South Africa’s criminal justice system.
Justice Madlanga cautioned against a criminal justice system that is compromised by corrupt functionaries, stating that it would enable criminals, particularly those in influential positions, to evade accountability for their actions. He stressed that corruption and dysfunctionality within the system contradict the expectations and rights of South Africans. Furthermore, he underscored that a well-functioning criminal justice system is essential to maintaining the rule of law and constitutional democracy.
The chairperson further elaborated on the various ways in which justice could be subverted, including intimidation, improper promises, and corrupt influence over decision-making processes. He described these actions as detrimental to the integrity of the criminal justice system. Justice Madlanga concluded by asserting the commission’s commitment to investigating whether the criminal justice system has been compromised by criminal syndicates, marking the beginning of a thorough investigative process.
