Cape town: Justice and Constitutional Development Minister Mmamoloko Kubayi has outlined a strategy to dismantle criminal networks through targeted, integrated, modern interventions and the strengthening of legislation. Kubayi tabled the department's Budget Vote in Parliament on Tuesday.
According to South African Government News Agency, Kubayi emphasized the interconnected nature of organised crime, which encompasses activities such as extortion, illegal mining, money laundering, and gang violence. She noted that corruption acts as the lifeblood of such criminal ecosystems, necessitating a coordinated approach from investigative agencies through to prosecution and the courts to effectively combat these crimes.
Cooperative efforts are already in motion, with the National Prosecuting Authority (NPA) collaborating closely with the South African Police Service (SAPS) through a special task team. This team was established following the interim report of the Madlanga Commission of Inquiry and aims to fast-track prosecutions related to corruption and state infiltration by organised crime.
A significant focus is on depriving criminals of their ill-gotten gains through asset forfeiture, a task being vigorously pursued by the NPA and the Special Investigating Unit (SIU). Notably, the NPA's Asset Forfeiture Unit (AFU) exceeded its targets last financial year, securing 481 freezing orders and recovering significant sums through civil asset forfeiture cases.
In parallel, the SIU has achieved notable successes, including major settlement agreements and recoveries for state entities. Efforts are set to intensify, with ambitious targets for the new financial year aimed at disrupting criminal enterprises and recovering state assets.
Legislative changes are also on the horizon to further support the fight against crime and corruption. This includes a Bill to protect whistleblowers, amendments to the Regulation of Interception of Communications and Provision of Communication-Related Information Act (RICA) to improve compliance and enforcement, and updates to the Criminal Procedure Act and other key legislations.
These initiatives reflect a comprehensive approach to enhancing the justice system's ability to tackle organized crime and corruption effectively, with the aim of safeguarding public resources and strengthening governance frameworks in South Africa.
