Kwaggafontein: The National Prosecuting Authority (NPA) is planning to re-enroll the extortion and money laundering case against well-known taxi boss Johannes Sibanyoni and others in the Kwaggafontein Magistrates Court in Mpumalanga.
According to South African Government News Agency, the case was previously struck off the roll after the prosecutor failed to appear in court. Despite this development, NPA Head Advocate Andy Mothibi stated that the NPA is within its rights to reinstate the case once legal requirements for re-enrollment are met. Mothibi emphasized the NPA's commitment to holding those accused of criminal activities accountable.
The NPA explained that disciplinary proceedings would be initiated against the absent prosecutor, who was found in contempt of court. On the day of the scheduled bail application, the prosecutor's absence led to the case being removed from the court roll and a warrant of arrest being issued against him. The case can only be reinstated with written authorization from the Director of Public Prosecutions: Mpumalanga Division. The prosecutor will face suspension pending the initiation of appropriate disciplinary action.
The NPA acknowledged the magistrate's authority to invoke relevant sections of the Criminal Procedure Act but stated that they would review the order to determine if it is the best legal approach for addressing the matter. The public has been urged to remain patient as the NPA addresses the situation both internally and with the South African Police Service.
