SIU Executes Search and Seizure Operation at JB Marks Local Municipality.


North West: The Special Investigating Unit (SIU) has conducted a search and seizure operation at the JB Marks Local Municipality in the North West this morning. The operation aims to gather evidence related to the ongoing investigation into the construction of the N12 flood line canal.

According to South African Government News Agency, the SIU carried out the operation in collaboration with the Hawks and the South African Police Service. The objective was to find documents that are crucial for the investigation. The SIU had previously attempted, without success, to obtain these documents voluntarily from the municipality since the publication of the proclamation on 4 October 2024.

The operation, authorized by a court warrant and a Presidential Proclamation, targeted the procurement process and alleged serious maladministration linked to the flood line canal project. The SIU collected various documents and electronic devices, including company registration documents, payment records, and electronic data from
laptops and mobile devices used by municipality officials.

The SIU is empowered by the Special Investigating Units and Special Tribunals Act 74 of 1996 to thoroughly investigate the allegations. This includes the authority to subpoena bank statements and cell phone records, search and seize evidence, and interrogate witnesses under oath. Should any evidence of criminal conduct be discovered, it will be referred to the National Prosecuting Authority for further action.
